Professor Christian Fernandes Gomes da Rosa, from Faculdade ESEG, of Grupo Etapa, participated last Friday (8) as a speaker on the panel on Contractual Rebalancing during P3C Nordeste, an event that brings together experts and public managers to discuss public-private partnerships (PPPs) and infrastructure concessions.
In his lecture, the professor highlighted the importance of the maturation of regulation and law from a risk management perspective, emphasizing that contractual rebalancing should be understood as part of a rational process of risk analysis and allocation. “The issue of rebalancing involves improving and maturing regulation and law based on the logic of risk management: identifying risks, estimating probability and impact, defining controls; transferring when efficient, mitigating when possible; accepting residual risk and allocating it to whoever best manages the risk or damage,” stated Christian.
The professor's participation reinforces ESEG's commitment to keeping the Law course connected to market transformations and the contemporary demands of public administration. The concepts addressed in the panel are constantly debated in his courses on Financial and Economic Law, Political Economy, and Administrative Law, in which students analyze the role of the State in the economy, the mechanisms for delegating public services, and the economic and financial balance of contracts.
According to the professor, understanding contractual rebalancing is essential to understanding how the State can act efficiently and sustainably in the provision of public services. “These contracts are complex, costly, and long-term. Economic rationalization should guide smarter regulation, capable of ensuring efficiency without losing sight of the collective interest,” he noted.
The classroom approach to this topic allows students to connect the theoretical foundations of Law and Political Economy to concrete situations experienced in the market and in public management, reinforcing the critical and practical training proposed by the ESEG Faculty course.
