Civil liability: concept and legal aspects

Civil liability, in addition to being one of the fundamental pillars of civil law, is a legal concept that plays a crucial role in contemporary society.

In this text, we will explore the concept of civil liability and its main legal aspects.

Understanding civil liability

Civil liability, in essence, refers to the legal obligation to compensate another person or entity for damages suffered as a result of an action or omission that violated a legal duty.

This obligation is based on the principle that everyone should act with reasonable care to avoid causing harm to others.

When this duty is neglected, those responsible may be required to pay compensation, determined by a judge in court proceedings.

Main legal aspects of civil liability

1. Assumption of civil liability

For someone to be held civilly liable, three main elements must be present: negligent or unlawful conduct, damage suffered by the victim, and a causal link between the conduct and the damage.

Without these elements, civil liability cannot be established.

2. Types of civil liability

There are several forms of civil liability, including contractual civil liability (when obligations arise from contracts) and extra-contractual civil liability (or tort liability, when it arises from unlawful acts).

Furthermore, there is objective liability (which does not require proof of fault, only a causal link between the conduct and the damage) and subjective liability (in which the agent's fault must be proven in order to establish the obligation to repair/compensate).

3. Liability for the acts of third parties

In some cases, a person or entity may be held liable for the actions of third parties.

For example, employers can be held liable for the negligent acts of their employees in the course of their duties, as well as parents for the actions of their children while still under their responsibility.

4. Exclusions of liability

There are situations in which civil liability may be excluded or limited. Examples include the victim's consent, self-defense, and force majeure.

5. Prescription and forfeiture

The right to compensation for civil liability may expire over time due to prescription or forfeiture.

Prescription refers to the loss of the procedural claim, that is, the loss of the possibility of filing a lawsuit to demand compensation (although the right continues to exist), while forfeiture is related to the loss of the right itself due to its non-exercise within the legally stipulated time.

6. Quantification of damages

Determining the exact amount to be paid as compensation can be a challenge.

Damages can be divided into material damages (such as medical expenses and property damage) and moral damages (which relate to the pain, suffering, and loss of quality of life of the victim).

Courts generally seek to compensate the victim in a fair and appropriate manner.

7. Case Law

Case law plays an important role in the evolution of civil liability.

Courts frequently issue rulings that set precedents for future cases, helping to shape the interpretation and application of the law.

Civil liability plays a crucial role in protecting rights and maintaining order in society.

Therefore, it is important to understand these concepts to ensure that justice is served when harm occurs due to inappropriate acts or omissions.
